Woman's slip and fall claim against Meijer is dismissed
Nancy Duncan sued Meijer, Inc., after she slipped and fell in the produce department of a store in Livingston County. She fell after stepping on grapes that she did not observe in the aisle of the store. Meijer employees testified that Meijer's policy was to check floors for debris on the hour. Duncan was unable to prove how long the grapes had been present on the floor. Therefore, she could not establish a cause of action for negligence by the supermarket in failing to reasonably identify and eliminate a fall hazard. Her claim was summarily dismissed and the dismissal was upheld by the Court of Appeals.
