Woman's breach of warranty claim against car dealer and manufacturer is dismissed
Dianne Walker-Houston claimed that her Mercedes Benz station wagon didn't have enough leg-room in the back seat. She didn't sue within four years, however, the proper statute of limitations for such a sale under the UCC, apparently. Her case against the Bloomfield Hills Mercedes dealership and the manufacturer were dismissed as untimely, and she appealed to the Court of Appeals.
The latter court upheld the dismissal, pointing out that the defendants' responses to her complaints to the dealership, which she alleged caused her to delay taking legal action, did not constitute an "equitable estoppel" precluding the statute of limitations from running.
