Woman cannot sue after fall in slippery aisle

Dorizella Fedrick was hurt when she fell in the automotive aisle at KMart.  She said she didn't know what caused her fall on the slippery floor, but that while she was on the floor an employee remarked that "somebody should have cleaned that up."  Testimony indicated that because of the spilling of various automotive products in the aisle, it was often more slippery, and there was also a suggestion that the cleaning contractor may have used the wrong product to clean the floor on the day of the fall. 

Nevertheless, the court held that Fedrick had no basis to prove that KMart "should have known" of the existence of a problem with the floor and therefore her claim was dismissed.
