Supreme Court overturns lower court ruling; dismisses claim against motorist's estate as untimely
This week the Michigan Supreme Court overturned the Court of Appeals and dismissed a personal injury lawsuit against the Estate of Laura Gabriel. The Court disagreed with the lower courts' judges and concluded that a statute governing suits by and against Decedent's Estates applied to make the instant case untimlely. The Court found the lower court procedure of authorizing a third summons to enable service of process on the Defendant to be inadequate to toll or extend the statute of limitations.
