Supreme Court dismisses product liability claim
This week the Michigan Supreme Court overturned the Court of Appeals and dismissed a wrongful death claim against the manufacturer of a muffler repair kit. The kit required the user to operate the vehicle for a set period of time after installation to allow the patch to bind to the muffler, but did not warn against idling the car in an enclose space. The Supreme Court held that the manufacturer was not required to include such a warning in its product, particularly where such a safety practice is well known among vehicle mechanics.
