Sheriff cannot sue Nationwide Life Insurance Company for breach of fiduciary duty
Jerry L. Demings sued the Nationwide Life Insurance Company its "Nationwide Retirement Solutions, Inc." and "Nationwide Financial Services, Inc." alter-egos, alleging that they breached their fiduciary duty to Demings' employees and others by illegally siphoning participants' deferred compensation plan earnings to Nationwide's benefit. Demings attempted to bring a class action on behalf of all employers and employees who were allegedly mistreated by Nationwide. The Sixth Circuit held that Demings' state-law claims were preempted by federal banking and securities law.
