Sewer system defect exception to governmental immunity is narrowly defined in dismissing claim
The Court of Appeals upheld the dismissal of several families' negligence claims against the City of Ann Arbor. The families' homes had suffered significant sewage flooding in their basements after a City water main burst and flooded the City septic system. The legislature has adopted an exception to governmental immunity where a trespass is caused by a defect in a municipal sewer system. The Court held that in tis case, however, the defect was in the City's water system, not the "sewage disposal system."
