Municipality responsible for liability resulting from "shared" police vehicle
Wayne County and several other entities created a joint task force for fugitive apprehension. Under a Memorandum of Understanding, they pooled officers and vehicles. Jacqueline Ivory was hurt as a result of the alleged negligent driving of Etonya Gay Williams, a City of Detroit police officer operating a Wayne County vehicle. The County argued that it was immune from liability, because the statute creating an exception to governmental immunity for negligent motor vehicle operation should apply only to vehicles owned by the entity and operated by its employee. The Court of Appeals disagreed and held Wayne County responsible for Williams' negligent driving as an AGENT of the County.
