Mold claim barred by passage of time prior to suit
Bridget Brooks attempted to sue her landlord, Willow Tree Village, to recover for health problems caused by the failure to repair leaks in her roof. Unfortunately, she waited more than three years after the problem developed before filing suit. She argued alternatively that she did not become aware of the problem, or did not connect her health issues to the presence of mold, until a time period less than three years prior to filing, however, the court found that this claim was inconsistent with her testimony and inconsistent with the [Engler majority's] Supreme Court rejection of "discovery tolling" of the statute of limitations.
