Michigan Head & Spine Institute loses PIP claim against State Farm

Pellumbesha Biba was injured in a motor vehicle accident and insured with State Farm.  Eventually, they became involved in a dispute over what benefits State Farm should be paying.  The suit was settled.  State Farm paid $35,000.00 and secured Biba's signature to a Release that waived any future claim to PIP benefits, with a singular exception for two years' services from the University of Michigan Health System.  The Michigan Head & Spine Insitute took over Biba's care and then attempted to bill State Farm for its services.  The Court held that the Institute had provided no grounds to justify failing to recognize and enforce State Farm's release from its PIP obligations.  The Institute's lawsuit against State Farm was dismissed.
