Man who admitted lying in his medical records cannot escape summary disposition of claim
Daniel Gettys sued Lisa Cowin after she crossed the centerline and struck his car. Gettys argued that he suffered all manner of back pain and left-side muscle and nerve injury. Unfortunately for him, he had complained of the same problems for years before the wreck, apparently. After his physician attributed his problems to arthritis, the Court granted summary disposition of his claim. Gettys appealed, arguing that he had lied about similar pain, prior to the wreck, in order to secure narcotic pain medication. Needless to say, his appeal went nowhere.
