Liquor warehouser convicted of conversion for failing to transfer inventory
Hard Luck Distributors had to sue its warehouse, Temperance, after the two became involved in a fee dispute. Hard Luck secured a judgment that Temperance was guilty of conversion for failing to transfer its vodka inventory to another warehouse. Temperance appealed, arguing that it could not be guilty of conversion because Hard Luck could not legally possess the inventory, and that in any event, its conversion was only "temporary." The Court of Appeals upheld the lower court's decision, pointing out that while Temperance could not deliver the vodka to its owner, it was legally obligated to transfer the inventory to another licensed warehouse upon demand of the owner.
