Libel claim against newspapers dismissed for violation of statute of limitations
The Court of Appeals upheld the dismissal of Arelious Ray Reed's libel claim against the Observer & Eccentric Mirror newspaper because Reed waited too long to sue. Reed argued that his statute of limitations was "tolled" or extended, during the period he pursued a claim in federal court. He failed to take into account, however, that tolling ceased when the federal court action was dismissed, making his subsequent state filing too late.
