Lawn company has no coverage for error in applying pesticide
Looking Good Lawns sued its insurer, Secura, after it mistakenly applied a non-selective herbicide to several lawns under its care. It argued that a herbicide endorsement in the policy required the insuer to cover the expenses incurred in repairing the customers' lawns, however, Secura argued that the herbicide endorsement did not "trump" two exclusions in the policy. The Court agreed with the insurer that exclusions that denied coverage for the insured's own work and for damages caused on the property where work was being performed both would control over the herbicide endorsement, eliminating any coverage.
