Law firm and company held in civil contempt for violation of court order regarding sale of assets
Glenn S. Morris sued R. Judd Schnoor and other entities as their mutually-owned insurance agency, MSG, fell apart. Amid allegations of fraud and other misconduct, the Court ultimately entered an order requiring MSG to secure court approval prior to any sale of assets. Some time later, the attorneys for MSG and the remaining order went ahead with a sale, executing a lien on the corporation for fees owed to the attorneys. The Court then held the attorneys and the owner in civil contempt and the latter appealed.
The Court of Appeals upheld the trial judge's decision, despite all manner of arguments about standing, due process, judicial recusal and improper procedure.
