Kreiner over-ruled by Michigan Supreme Court in McCormick case.

Late last night, the Michigan Supreme Court announced that a decision had been published in the long-awaited McCormick case.  As anticipated, the much-reviled Kreiner decision was over-ruled by the Justices on a 4-3 vote.  The opinion runs 65 pages, including dissents, and we haven't yet had the opportunity to evaluate the operative language to assess where this new decision leaves seriously injured clients hoping to meet the threshold for filing a claim against the at-fault driver in no fault claims.  We'll update weblog as soon as we have given the opinion careful analysis.  It has at least relaxed the "life-altering" interpretation that Justice Taylor had engrafted upon the "serious-impairment" requirement in the statute.
