Insurer required to defend and indemnify its insured for sale of defective steel
Amerisure Mutual Insurance Company sold liability coverage to the Hall Steel Company, however, when Hall mistakenly provided "soft" steel for the manufacture of windshield wipers, it denied coverage for Hall's error. The trial court upheld two separate exclusions in the insurance policy, however, on appeal the higher court concluded that neither alleged exclusion actually applied to Hall's defective steel. Amerisure was required to defend and indemnify Hall in accordance with the contract it signed.
