Inmate's claim for knee surgery summarily dismissed
The Court upheld the summary disposition of Clifton Moffat's malpractice claim against the Department of Corrections, concluding that he had not stated a proper cause of action for gross negligence, medical malpractice or "deliberate indifference" to his medical needs. The Department had refused to approve him for surgical repair, concluding that he was a proper subject for rehabilitation without surgery, and that rehabilitation was sufficient without surgical repair. The Court held that while the inmate might disagree with the plan of treatment adopted by the DOC, it and all persons acting in privity with the Department, were properly granted summary disposition.
