Illegal arrest claim against Detroit Police officers is dismissed
Raheem Akbar sued the City and two officers who responded to a neighborhood shooting. They arrested Raheem and his brother, but ultimately determined that the brother, Rashad, was the sole shooter and released Raheem. He then sued for wrongful arrest.
The Court held that the officers were immune from prosecution because they acted with probable cause in arresting Raheem. Because they had reasonable grounds to believe that Raheem was a participant in the firearm discharge, there was no basis to claim false arrest or malicious prosecution.
