Homeowners' claims against City of Grosse Pointe Farms were wrongfully dismissed summarily

In its recent decision in Sinclair v. City of Grosse Pointe Farms, the Court of Appeals majority reversed the trial judge who had summarily dismissed the various homeowners' sewage backup damage claims. The Court noted that the homeowners had created genuine issues of fact with regard to whether the City could avoid statutory responsibility for the damages that resulted when wastewater pumps failed, sending raw sewage into the Plaintiffs' basements.
