Homeowner insurance claim denial is upheld by Court
State Farm denied Basim Aljazi's claim arising out of cracks on the first floor of his home. It had previously paid for damage to the foundation and second floor caused by a burst pipe, but its inspector claimed that the first floor cracks must have pre-existed the water damage. Aljazi disputed this claim, however, he was late in responding to State Farm's Motion for Summary Disposition and the trial court dismissed his claim. The Court of Appeals could not decipher a proper foundation for the claims contained in his late response, so it upheld the lower court's dismissal.
