Higher court overturns death settlement allocation where trial judge did not conduct hearing
The Court of Appeals held that an Oakland County judge committed reversible error when he enforced a Personal Representative's recommended death allocation among the Interested Persons over the objection of other family members. The Judge was aware of the objections but refused to schedule a hearing or appoint a Guardian for the minor Interested Persons. The Court of Appeals overturned the proposed allocation and ordered the Judge to comply with the provisions of the Wrongful Death Act.
