Farm Bureau's bid to delay trial on PIP benefits by change of venue is denied (after a year of delay).
This week the Court of Appeals unanimously held that Farm Bureau could not move a PIP action from Wayne County to Ingham County. The trial court had already denied the request and Farm Bureau appealed, arguing that as a matter of "convenience and necessity" it should be allowed to change venue. The Court pointed out that since a PIP action is based on contract, not a "tort" or negligence theory, thelocation of the injury is not determinative and the plaintiff's choice of venue is accorded deference.
