Estranged husband awarded 5% of spouse's injury claim cannot overturn ruling
Jimmie McCall appealed after he was awarded only five percent of a settlement awarded to his wife in a settlement with the Henry Ford Health System. McCall argued he was entitled to a greater share. The Court of Appeals rather summarily rejected McCall's appeal, concluding that the lower court's allocation was not erroneous, given the facts: McCall was estranged from his wife, failed to show a "close family relatiionship," rarely visited her in her nursing home, and he had not shown that he suffered a substantial loss.
