In Andrews University v. Barnaby, the Defendant counter-sued Andrews after it sued her for unpaid tuitiion. Barnaby argued that the tuition lawsuit was filed in retaliation for the academic grievance she filed. The Court held that she owed the tuition, and wasn't entitled to a jury trial on either that issue, or on her claim for retaliation.
