Court reverses trial judge's dismissal of plaintiff's claim caused by discovery issues
A group of doctors was allowed to continue pursuit of their claims after the Wayne County Circuit judge dismissed them severaly years ago. The Birmingham Royal Oak Medical Group sued Intermedcorp, Inc., but failed to comply with discovery orders. The judge dismissed their claim and awarded the defendant sanctions. The doctors appealed and the higher court concluded that the judge had not adequately explained his basis for assessing the harshest possible sanction. The case was sent back to him to re-evaluate the sanctions awarded.
