Court reverses summary disposition of victim's hand injury claim

The Court of Appeals reversed a lower court ruling dismissing a motorist's injury case and returned the case to the lower court for further investigation.  The case involves Walter Kryzanoski's claim that he suffered a severe and disabling fracture of his dominant hand in a motor vehicle collision.  His case against the at-fault motorists, Philip and Maureen Kaule, was remanded to allow the court to assess whether the injury constitute a "serious impairment of bodily function" under the standard elucidated in the Supreme Court's  2010 McCormick decision.  It had originally been dismissed after analysis under the Kreiner case in which the so-called "Engler Majority" appended a "life-altering" test to the statutory requirement.
