Court rejects No Fault insured's claim that she is owed attorney fees
Icie Gardner McGhee prevailed in her medical expense claim against State Farm. The trial judge denied her fees, however, and awarded her only $578 in taxable costs. She appealed, but the Court of Appeals rejected her claim. It noted that State Farm had relied upon an IME doctor's erroneous conclusion that her medical treatment was not accident-related. Even though the IME directly contradicted her treater's opinions, State Farm was under no obligation to reconcile the differing medical opinions and therefore its denial was not "unreasonable."
