Court rejects claim that Florida's reconstruction of beaches created private, not public property

The U.S. Supreme Court rejected the claim by Florida beachfront property owners that the State had "taken" their property by creating public beaches after severe erosion had occurred.  The Judges were unanimous in their opinion that the newly created property did not belong to private individuals and did not harm their property values, but the four very conservative Justices (Scalia, Roberts, Thomas and Alito) used the occasion to argue for activist dicta creating a right to sue state judges when court decisions diminish property values.
