Court overturns lower court's limitation on discovery in business interference case
In Klarich Associates, Inc., v. Dee Zee, Inc., the Court of Appeals reinstated the plaintiff's action claiming interference with a business relationship. It noted that the Oakland County Circuit Court had too restrictively interpreted the Defendants' alleged violation of fiduciary duty and also unduly limited the parties' formal discovery. It reminded the lower court that Michigan has a long-established "open, broad... policy that permits liberal discovery of any matter, not privileged, that is relevant to the subject matter involved in the pending case."
