Court overturns lower court order that would effect indefinite stay of proceedings

This week the Court of Appeals overturned a lower court's failure to lift a stay in Savitri Bhama's malpractice case against her lawyer.  The parties had originally agreed to a stay of proceedings in 2003, while the Plaintiff appealed her employment grievance against the State of Michigan.  In December of 2010 when they asked the court to lift the stay so that the case could be resolved, the Court refused.  The Court of Appeals held that it was an abuse of discretion for the tiral judge to continue the case indefinitely and that the stay should have been lifted.
