Court of Appeals rejects City's argument that it is immune from negligently-caused emotional or psychological damages
In Mimms v. Maurer, MEEMIC and City of Southfield, the Court of Appeals rejected another municipality's over-reaching argument that "bodily injury" does not include any damages for emotional or psychological injury. This series of cases represented a rare win for victims in the insurer-dominated Michigan Supreme Court, and also elucidated how arrogant and over-confident insurance and institutional defendants have become in the current politicized court environment.
