Court of Appeals partially upholds summary disposition of medical company's claims, based on statute of frauds.

The Court of Appeals recently issued a very brief opinion upholding the dismissal of the B & H Medical company's defamation, negligence and injurious falsehood claims against one of the two defendants B & H had sued.  It reinstated the case for further discovery against the remaining defendant, pointing out that there was a material question of fact with regard to when the false debt report relating to the Plaintiff was actually published.  Since reasonable jurors might accept either interpretation of the record with regard to the first publication date, the case was remanded for further discovery on that issue.
