Court of Appeals overturns two trial judges' disability awards to State employee

Kevin Tasson sued the State Employees Retirement System in Marquette County, alleging that he was wrongfully denied duty disability retirement.  The Circuit judge agreed and awarded benefits.  The state system appealed and the judge's decision was overturned.  It concluded that there was adequate evidence to support the State's decision that Tasson was not "permanently and totally disabled" from his Department of Corrections position.

The Court of Appeals made a similar decision in striking down the trial judge's holding in Whaley v. State Employees Retirement System, a Baraga County case.
