Court holds couple waited too long to sue for malpractice

Robert and Lisa Anderson sued their attorneys, David & Wierenga, in Kent County Circuit Court, alleging that the attorneys had not adequately performed their due diligence in preparing for the Andersons' purchase of a car dealership.  Almost three years after closing on the dealership, the Andersons sued the attorneys and the attorneys claimed that the two-year statute of limitations had run.  The Andersons' new attorneys produced e-mail exchanges with the attorneys that would suggest a continuing relationship with the attorneys, however, the Court held that the correspondence related to new matters and therefore did not extend the statute of limitations.  In particular, the court held that efforts by the attorneys to cure or address the problems arising out of the purchase--or even the attorneys' mistake in earlier representation--did not extend the statute of limitations.
