Court holds commercial establishment with allegedly inadequate driveway is not liable for motorist's injuries
Kelly Erhart was injured when a vehicle leaving Fruit Ridge Hayrides, LLC, pulled out in front of him. Erhart argued that the driveway that served Fruit Ridge was grossly inadequate, resulting in traffic tie-ups and visibility issues that contributed to the at-fault driver pulling out in front of him. The trial judge summarily dismissed his claim and the Court of Appeals confirmed. It held that any changes to the road in front of the Hayride establishment were within the jurisdiction of the road authority and that Erhart's attorneys did not provide adequate proof of the inadequacy of the driveway.
