Court dismisses claim of woman who fell on black ice on apartment sidewalk

Celestine Borsos sued Muirwood Square Associates, LLC, arguing that it was negligent in removing ice and snow from an apartment sidewalk.  She alleged that she suffered injury when she fall on black ice.  The manager of the complex testified that he checked the sidewalk at 8 am and before he left in mid-afternoon and did not see any ice.  Borsos fell at about 6 pm and her expert witness could not confirm that the ice was present prior to sundown.  Therefore the Court held that Borsos had not met her duty to present evidence that the landlord should have noticed the black ice and addressed the hazard.
