Court dismisses accounting action brought by alleged fraud victim

This week the Court of Appeals upheld the lower court's dismissal of the plaintiff's action seeking an accounting for the $200,000.00 he had loaned a pair of real estate developers.  The plaintiff sought further documentation of a transaction which he argued was designed to "squeeze" him out of his loan through the use of a "straw" man.  The plaintiff also sought leave to amend his complaint to join additional claims.  The Court of Appeals affirmed the summary disposition of the alleged victim's lawsuit, finding that he had created no genuine issue of material fact with regard to the alleged misconduct.
