Court awards sanctions to insurer against company saying it didn't investigate thoroughly pre-suit
C & D Capital LLC sued the Colonial Title Company and other entities, alleging negligence by the title company and agent. The Trial Court summarily dismissed the claims because the nine mortgages upon which C & D sued had been discharged before a closing occurred--meaning a reasonable factual inquiry by C & D would have disclosed that a suit was not warranted by law or fact. The Court of Appeals upheld this result but reversed the lower court's failure to award sanctions against a third-party.
