Court addresses sanctions for frivolous claim
In what is probably the final chapter of a piece of litigation arising from a Wexford County contaminated well site, the Court of Appeals issued a ruling on the assessment of sanctions. The Court held that attorney James P. O'Neill remains responsible for continuing a frivolous lawsuit, although he should receive a credit for any sanctions paid by the predecessor attorney who initially filed the litigation, Mark Dancer.
