CMU prof and undergrad spouse may go forward with illegal retaliation First Amendment claim
This week the Sixth Circuit Court of Appeals reversed the trial judge and partially reinstated a First Amendment retaliation claim brought by a CMU professor. The Court held that the trial judge properly dismissed part of Benison v. Ross, but ruled that he erred in summarily dismissing the claim that the University and its president had wrongfully sanctioned the professor and her undergrad spouse to retaliate against the spouse's invovlement in a no-confidence resolution.
