Jackson & Church Company and its owners sued Bay City Shovels, Inc., (BCSI) and its owners, to recover on a promissory note. BCSI counter-claimed on various grounds but several times failed to provide reasonable responses to interrogatories and requests to produce. Only days before a court hearing to sanction BCSI (not the first), BCSI delivered thousands of pages of "irrelevant" paperwork to the Plaintiff. The Court dismissed BCSI's counter-claim, holding that its repeated willful failure to provide discovery justified permanent dismissal of the action.
