Claim arising from trip over pallet in Big Lots Store is dismissed

Lois LaFontaine turned an aisle while shopping at the Oakland County Big Lot store and her shin struck a pallet protruding into the aisle.  She fell and allegedly suffered injury.  The Court dismissed her injury claim, finding that the pallet was an "open and obvious" hazard which the store owed no duty to remedy.  The Court also held that the case arose from a "condition" on the premises, and therefore a claim for negligence against the store employees for leaving the pallet in a "camouflaged" location was untenable.
