City of Auburn Hills not liable for defective road
The Court of Appeals upheld the dismissal of Sally Palaian's injury claim against the City of Auburn Hills. Palaian claimed that an asphalt "cut-out" created to effect repairs undertaken by the City had caused her to crash her bicycle. She did not provide the City with a separate notice of her injury within the 120-day notice period, however, and the Court held that the police report created by a City police officer on the day of the injury was not adequate to meet the statutory ntoice requirement.
