Case of man suing without lawyer is dismissed for failure to provide discovery
Edward Pragasam sued Ciena Health Care Management and others. The Appellate Court did not explain the nature of his suit in the opinion upholding its dismissal. The trial court had dismissed his claim because he did not comply with the Defendants' multiple discovery demands. The court noted that a litigant pursuing a claim without a lawyer is entitled to some leniency and held to less stringent standards. Nevertheless, and even though he displayed no wrongful intent, the plaintiff's claim was dismissed because his choices regarding appearing for deposition and providing discovery (or not) were "conscious and intentional...not accidental or involuntary."
