California recognizes insured's right to sue insurer who destroys evidence
Lawyers USA reported this week that a California Appeals Court has recognized a cause of action in favor of an insured who could not pursue a product liability claim because his insurer, State Farm, disposed of an allegedly defective tire. Under the facts of the case, the Court agreed that State Farm could be sued for "third party spoliation" of evidence. Michigan's Supreme Court, while dominated by activist judges energized to protect insurance interests, have been reluctant to recognize this cause of action in Michigan.
