"Black ice" case dismissed after man suffers broke ankle returning movie
Carl Bath admitted that the blue ramp in front of the movie store at the Brownstown Shopping Plaza looked like it may have been "damp." On that basis, and the fact that temperatures were below freezing, Bath's injury claim against the shopping center was summarily dismissed because the black ice hazard on the ramp was "open and obvious" and the owners therefore "owed no duty" to address the hazard.
