Bank vs. title insurer in dispute over indemnification: bank wins with claim that summary disposition was improper

In a dispute over whether First American Title Co. had to indemnify Fifth Third Bank for damages sustained at a fraudulent mortgage closing, the bank won.  The Court of Appeals ruled that the lower court had mistakenly decided issues of fact in rendering summary disposition.
