Automatic 12 hour detention of domestic assault defendants is not a constitutional violation
In Fields v. Henry County, the Sixth Circuit Court of Appeals responded to the claim that it was unconstitutional for the Defendant County to hold accused domestic assaulters for 12 hours, without any exercise of discretion in the holding decision. The Court held that it was not a violation of the 8th and 14th Amendments.
