Another foreclosure victim's claim against the bank bites the dust

In Davis v. GMAC, the plaintiff homeowner sued his mortgagee, arguing that the bank's procedures and foreclosure process were negligent and inflicted emotional distress.  The Court rejected Davis' claims and on appeal the dismissal of the suit was upheld.  Michigan citizens cannot collect emotional distress damages against foreclosing banks.
